MODA Terms of Service

Introduction

Welcome to MODA (getmoda.app). These Terms of Service ("Terms") govern your use of the MODA mobile application (the "App") and any related services we provide. By downloading, installing, or using MODA you agree to be bound by these Terms. If you do not agree, do not use the App.

About MODA

MODA is a personal wardrobe and styling assistant. It helps you digitize your clothing, generate AI-assisted outfit combinations, and plan what to wear based on weather, your calendar, and your preferences. All outfit suggestions are produced automatically for inspiration only and are not professional styling advice.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. By using MODA you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

Your Account

To use most features of MODA you need to create an account using an email address, Sign in with Apple, or Sign in with Google. You are responsible for:

Subscriptions and Billing

MODA offers optional premium subscriptions purchased through the Apple App Store. Currently offered plans include:

Exact prices, trial eligibility, and renewal periods are displayed in the App before you confirm the purchase.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price, unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account on confirmation of purchase.

Free trials. If a free trial is offered and you cancel before the trial ends, you will not be charged. Any unused portion of a free trial is forfeited when you purchase a subscription.

Managing and cancelling. You can manage or cancel your subscription at any time in Settings → [your name] → Subscriptions on your iOS device. Deleting the MODA app or your MODA account does not automatically cancel an active subscription.

Refunds. All payments are processed by Apple and are subject to Apple's refund policies. Refund requests should be submitted through https://reportaproblem.apple.com.

Free and Premium Features

Some features are available for free. Others require an active subscription. We may change which features are free or premium at any time, subject to your rights under applicable consumer law and the terms of any subscription you have already purchased.

Your Content

You retain ownership of the photos, outfits, and other content you upload or create in MODA ("Your Content"). By using the App you grant MODA a non-exclusive, worldwide, royalty-free license to host, store, display, process, and transmit Your Content solely for the purpose of operating and providing the App to you (for example, to sync your wardrobe across your devices and to generate outfit recommendations).

You are responsible for Your Content. You represent that you have all necessary rights to the photos you upload and that Your Content does not violate the rights of any third party or any applicable law.

AI-Generated Recommendations

MODA uses automated algorithms and AI models to generate outfit combinations, style suggestions, and other recommendations. These suggestions are provided for inspiration and personal use only. MODA does not guarantee that any recommendation is accurate, suitable, fashionable, or appropriate for any particular occasion, and you use them at your own discretion.

User-Submitted Feature Requests

If you submit feature requests, ideas, or feedback through the App, you grant MODA a perpetual, royalty-free, worldwide license to use them for any purpose, without obligation to compensate you. Submissions may be moderated before becoming visible to other users.

Intellectual Property

The App, including its design, source code, trademarks, logos, and generated content (other than Your Content), is owned by MODA and protected by copyright, trademark, and other laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, or lease any part of the App.

Third-Party Services

MODA uses third-party services (for example, Apple App Store, Apple WeatherKit, Google Sign-In, PowerSync, Sentry, PostHog, Meta, and TikTok) to operate the App. Your use of these services may be subject to their own terms and privacy policies. We are not responsible for the practices of third parties.

Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and use your information. See https://www.getmoda.app/privacy.

Termination

You may stop using MODA at any time and delete your account from the Profile tab in the App. We may suspend or terminate your access to the App if you breach these Terms, if we are required to do so by law, or if we discontinue the App. Upon termination, your right to use the App ends immediately.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. MODA DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR THAT ANY RECOMMENDATION WILL MEET YOUR EXPECTATIONS.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under the consumer protection laws of your country of residence.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. MODA'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE AMOUNT YOU PAID MODA IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR EUR 50 IF YOU HAVE NOT PAID ANYTHING).

Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify you in the App or by email and update the "Last Updated" date above. Continued use of the App after the update means you accept the revised Terms. If you do not agree, stop using the App and cancel your subscription.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law rules. Mandatory consumer protection laws in your country of residence still apply.

Apple-Required Terms

You acknowledge that these Terms are between you and MODA, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
